Adjudication Fees
There are costs associated
with being an Authorised Nominating Authority similar to
that of any commercial enterprise. These costs are off set
by charging fees. ANA's are permitted to charge fees under
the Act.
ASC has
recently conducted its own market research and has found
that ASC is in the low fee range out of all ANA’s yet is
still delivering fair and just outcomes to both claimants
and respondents.
It is the policy
of ASC that no determination will be released until the
Adjudicator is paid the Adjudication fees. Accordingly,
once the Adjudicator has made a decision, ASC will forward
a letter to both parties advising each party the amount of
the fees. Once the claimant and / or the respondent have
paid the fees for the purposes of release the decision
will be released to both parties. The decision will state
who is liable pursuant to the Act. Therefore, if the
claimant has paid 100% of the fees, but the decision
states that the parties are equally liable, the respondent
must reimburse the claimant for their share of the fees.
Fee Structure
Fee structures are as follows:
Adjudication Application fee
- $250.00
Adjudication Certificate fee
- $200.00
Adjudicator fee
- An hourly
rate fee is charged by the Adjudicator. The fee
charged is $280 per hour excluding GST ($308 per hour
including GST). An ANA administration fee is included in
these hourly rates.
Adjudication Applications under $5,000.00
(excluding GST) -
ASC has a set an adjudicator fee of $500.00
(excluding GST) for these low value adjudication applications.
